Inside the Class Action Lawsuit Filed Against Electric Zoo Festival

Electric Zoo was hit with a class action lawsuit following events at this year’s festival.

A pair of attendees from the 2023 Electric Zoo festival have filed a class action lawsuit against organizers over what they’ve called “a nightmare endured by thousands of electronic music fans.” According to RollingStone.com, the two plaintiffs Nicole Brockmole and Lauren Bair

The lawsuit was filed on the 13th of last week in a New York district court. According to a statement obtained by Rolling Stone, the two individuals seek damages on “behalf of all affected patrons who paid for ticket(s) for access or entry to [Electric Zoo] were not granted access.”

“In addition to Friday’s cancellation, and perhaps more egregiously, things turned worse for Electric Zoo fans on Sunday when they were left to languish in heatwave for hours after being greeted by never ending lines to enter the festival and eventually denied entry because the venue was oversold and overcrowded,” the lawsuit states. With the lawsuit filed, Rolling Stone reached out to Electric Zoo representatives for a comment and hasn’t returned for comment on the suit. The festival promised refunds for individuals who had Friday passes or Sunday passes who were denied entry, but there hasn’t been any information on what this process is.

According to PageSix, there was more to the picture than the initial cancelation post that Electric Zoo posted. An insider told PageSix that Avant Gardner, who purchased Electric Zoo last year, “bought the festival, and then fired everyone who ran Electric Zoo, and then rehired everyone once they found out they really couldn’t put it on.” The same source told PageSix that supply chain issues weren’t at hand, but the festival waited “very late in the game” to start planning and “were not reserving trucks, equipment, inventory, putting stages together.”

Brockmole traveled from North Carolina while the other plaintiff Bair came from Arizona to attend the festival. They are only a couple of the thousands who decided to travel to New York for Electric Zoo but still experienced the cancelation of Friday and a denial of entry on Sunday.

More information is expected to come in the coming weeks about the lawsuit and refunds that are expected by the festival. The festival still hasn’t made a statement about what happened the weekend of EZoo and what the plans are for the festival’s future.
